Guys,
As KB allude to the NOLs are one of the reason for KKR buyout because they use it to offset future profit. Since KKR remove the 2 board members, if a buyout take palce.. is this an internal buyout? Only an internal buyout can be treated as no ownership change so they can keep the NOLs in place.. I'm missing something? I think so. just want to make sure
Can someone out there please confirm that even current SHITTY POR allow to take advantage of the NOLs upon emergence? I thought they have more then 50% the original debtors and able preserve NOLs with this shitty POR in place.
5B in NOLs are no joke...

I would be willing to bet that somewhere in a redacted document that the Judge ruled they could go ahead and keep the NOL's without regard to BK tax codes...this ruling will of course supercede any case law or precedent...F_cking joke. Those NOL's were supposed to be our lifesaver. The judge allowed that conversation to take place in secrecy. The Goon with the Gavil strikes again.
