what is going on, why is the phone dead and no one is answering?
I DO NOT understand why there has not been another extension, they have to announce 7 days before the final sale order.
Why has the game changed?
Why is Kodak not playing by the rules?

I bet they ARE playing by the rules - but there's some arcane weasel-worded clause that they are following / taking advantage of.
And I think that most fair-minded people have come to the conclusion that the patent sale is up-in-the-air.
Unless they are running a QuiBids type of auction where the price goes up by pennies...

That is true, the document stated that at any time, they could stop the auction, take negotiations private and discuss whatever deals they wanted to.

And my guess at the moment is that someone is trying the acquire the patents by acquiring the company.

From the clues we've gotten,
assuming at some point the auction stopped and they started talking about a takeover,
when would that have been?
When was there a "tell" that there was no longer an auction happening and that things had gotten much bigger than that?

Everyone has always said that.
Why pay 3 billion for some patents, when for X more you can get whole company, and 4.5 billion in revenue, AND go after ALL the players in the smartphone and tablet space to create even more income!
If it was me, that is exactly how I would do it!

Chris runs the Marketing organization, which has OCMO (Office of the CMO) reporting into it. Chris' job is public knowledge, so I feel OK saying it. PM me if you want to know who runs OCMO...lol

As mentioned earlier today and as clearly stated in the rules...kodak has up until the very last minute to adjourn the final sale hearing...meaning?...until sept. 19.

Kodak did NOT submit a NEW hearing date on August 13 if I remember correctly.
There are NO rules for when Kodak must submit a new hearing date.
The only rules are:
1) Kodak must announce a deal within 2 days of when one is signed.
2) The hearing date must be at least 7 days after the announcement.

SBG But didn't Pro have a point regarding takeovers / posion pills / etc. I remember AP announcing it in July 2011, but I'll have to admit I didn't understand the actual financial ramifications... ...and if you fail, you can go Bain on Kodak, sell everything of value a la carte, and the write off the losses against operating income.
Kid makes it out like buying Kodak would be a loser's game, smart people know how much worth is inherent in the company.
Buy whole thing for 6B
3B in liabilities
= 9 B costs.
-1 B cash -6B patents (est.) -6B division sales -1B 218 -2B kiosks
With that calculation the "company" would be 7B in the black, or $28/share.

Poison pill just states that the max that anyone can own is 5% of stock, that is all.
But if there was an offer, the BOD can of course talk about it.

That seems high to me mike, but i would take it!!! SBG mike appears to be throwing out the stupidest most insane numbers I've ever seen, very close to the kind of numbers diamondrock was throwing around (2.5+billion for eastman business park, remember that? hahaha)

Right pro...kodak filed it on august 17. 3 days prior to what that initial final sale hearing date was. But i still have no clue where that 2 day reference is coming from.
