1) 5 weeks is a decent amount of time to structure a deal
2) 2 weeks ago Kodak hired an ANTI TRUST attorney to advise on the sale of certain patent portfolios.
3) In the last few days a Korean law firm was retained for some work that involves patents and trademarks.
4) Kodak has a BK schedule that calls for Kodak to lose EXCLUSIVITY to file a POR on Oct. 15th
5) Laura Quatela is expected to leave after her business unit is sold in a few months. Keeping her on seems to be a gift. Laura is NOT actually running those businesses and performs almost the same operating function as did Phil Faraci. In other words, Quatela's main importance to Kodak involves the DI patents. Once they are sold she is expendable. Allowing her to stay on until next year is a GIFT.

It does NOT matter to me if the sale is delayed for another week. LONG term INVESTORS do NOT focus on short term events to understand the Intrinsic VALUE.
More time just allows more LONG term investors to buy more cheap securities.
Most securities do NOT move in a straight line. There are periods when they move DRAMATICALLY UP and down.
SUCCESSFUL VALUE investors simply BUY when they are down, and then PATIENTLY wait for the VALUE to be recognized.

Why I don't expect news tommorow:
Adversararies get to object to a final sale order. Kodak is asking for a Summary Judgement on the 14th regarding 8 patents. Kodak in a filing said they would release sale details after the final order.
Kodak could file a partial sale or licensing agreement but details won't be released publicly. With the recent news, I would speculate that the patent sale was not as good as expected.
The 14th is important. This will move the legal moass forward. A final order allows the appeals process to move forward. I'm expecting a motion to extend the POR deadline.
I'm still buying and like the story long term.

MicroKing, The COURT ordered INSTRUCTIONS for the "363" sale REQUIRE a public announcement of the sale, one week prior to the hearing date.
Certain details MUST be made public in order to MEET the court requirements.
The PRICE of the deal is of GREAT importance to the creditors.
The creditors MUST have access to a PUBLIC announcement of the SALE price.

Pro, I'm going from a filing that says Kodak will release details in WSJ after final order. I don't dispute to public announcement just don't think it will be on the 12th. Doesn't make sense to release news and have a hearing on the 14th for a summary judgement regarding 8 patents.
Cox, Apple is not going to buy the patents. They are on a roll at winning patent lititigation. Time is on Apple's side. Samsung is my wag.
If the 14th is adjourned and news is released on the 12th, Apple is the winner, but that is highly unlikely. We will know soon but it think the process will be extended.
