Decision day looms, will it be another delay?

Also what type of haircut does the pps take should another delay happen? And before everyone jumps on me for being so negative, just hear me out. We have to look at how Kodak has handled this situation thus far. They have already had atleast two delays in the original auction announcement plus they rejected an offer to sell patents prior to chapter 11. There is no reason to think Kodak will make a haste decision just to sell the IP. Kodak is trying to get their price and seem content on taking whatever time necessary to get it.A delay does not mean all is lost but it certainly has implications for certain longs looking to free up some of their investment without having to take a loss. What would be catastrophic IMO is should Kodak release a statement saying they will keep the IP without some major licensing agreement being announced. Very likely IMO another delay spells teens. If so, who is adding?

Your getting to the point where the bankruptcy process should start to pick up a little speed, but until we know Kodak's plans and cash position from asset sales, every opinion, well researched or to just start trouble, is on hold, until the news blakout cycle is broken.

why not if the decision by Gropper is on the 14th why wouldnt the general counsel of Kodak not request another 1 week extension from the 14th onwards? It only makes sense. The 8 patents are critical i would presume. If Apple loses through Flashpoint the 8 patents the bidding wars heat up further between all interested parties. Other parties also want to know " who are the ultimate owners of said patents. On Wednesday it will be heard if Judge Gropper knows his decision is positive for fridays ruling then an extension will be given. If he knows he ruling for Flashpoint there will be no further extension. Just my thinking thiis morning. I do believe Flashpoint probably did work with Kodak at the time but collaboration doesnt constitute not paying a royalty fee for the usage of the patent. Kodak would have ample protection to garner royalty from any products formulated by this collaboration. Kodak does not create inventions and through collaboration collect no royalty. Judge Gropper will see through it and their agreements that were in place. Apple/Flashpoint will lose on Friday. Flashpoint did not create any of those 8 patents. Kodak created each and every one of those 8 patents. No one can rule faster than Judge Gropper. Flashpoint cant just say we collaborated with Kodak ....we are partners. Yes Form products together but collect a royalty from said products. It does not give the right for Flashpoint to say they own said infringed patents. Judge Gropper will rule 100% fully in my humble opinion. Just curious how it will all end. Odds favouring an extension is very probable this wednesday. If Gropper knows he is ruling in Kodaks favour. Why not extend for another 7 days from his ruling. The pricing of the whole patent portfolio will double triple quad within the week as a real battle could ensue for the whole entity of patents Kodak owns. Its historical architecture and arts of the patent porfolios the major companies are swaying for. I have noticed that at wal mart many similar cameras from kodak are now design changed and being sold as Fuiji cameras. Even kodaks waterproof video camera identical to the one they sold has Fujis name on it. Its amazing how the designs have now been passed on to Fuji. I noticed it in the websites. Fuji has a greater presense in many division sellers such as Wal Mart. If you look at other locations. Same thing. In looking at Fuji's web site. I cannot find these camera offerings the new ones i see at the wal mart site anywhere on their main Fuji web site. I do believe Kodak and Fuji have a deal going down with each other for their camera division and in return for that Fuji is exiting the film business. Kodak will have a complete monopoly in this arena. It will be ready for sale in 2013 with the 3 contracts renewed with the movie studios. A delay will be beneficial only if Gropper knows that on the 14th a positive decision is laid down by THE JUDGE himself. A grant will be given for another 9 days. My 2 cents worth for the board. Enjoy my thoughts. 5th extension is coming. Its not a business for Kodak to collaborate without collecting a royalty for any usage of their intellectual property.

You truly think Apple's claim to 8 patents out of 1100, once ruled upon ,would cause the price being offerred to double or triple?

I don't, Kodak could just scale the cost of any deal they make on the courts ruling regarding the 8 patents. One price if the 8 patents are Kodak's, a second price, if the court rules against them. And since Kodak and Samsung are working together already, an enhanced working relationship between Kodak & Samsung makes sense.

Just to throw this in since there's been mention of Flashpoint who has also laid claim to the ten patents. I posted this long ago but could never corroborate it...not that I really tried. www.businessweek.com/news/2012-08-01/kodak-wins-partial-victory-against-apple-in-patent-fightAccording to the following, found near the bottom of the article, Gropper didn't merely rule against Flashpoint for the 218 and 335 but as well for three others. Not that I feel any of us really/truly take flashpoint seriously. << Gropper also ruled against Flashpoint Technology Inc. with respect to the two patents and three additional ones, according to the decision. >>

Even if Gropper gives it to Kodak, Apple will just appeal and take it to another court for further delays, but, we should still see a bump in the pps.

If you guys are saying that Apple will not bid until a final decision is tendered regarding the patents then the auction should have been postponed until Gropper ruled on all the ten patents. However, I find it hard to believe that contested 8 patents out of 1100 would prevent the big companies from bidding aggressively. At this point, if there is a delay, Gropper rules against Apple on the remaining patents and the pps goes up I'd be okay with it. Just not a fan of being dead in the water. But we are not alone, Kodak's current employees, The retirees and even the bond holders feel our pain. Sucks being in the dark.

Kodak should delay it as long is they need to. No rush, here. I wouldn't be surprised or upset at all if they delayed it again. I would only be upset to find out crapple won the auction for under 1B, that would actually piss me off.

Canada,
Not being negative, but I think Kodak would go the c7 route before whoring the patents to Crapple for under a billion.

agree there are many scenerios on Kodaks doorstep. Can someone here post the 8 patent descriptions on this thread for viewing. Cut and paste it. I think they are important. I was checking the camera resellers selling fuji. You have a good point. Wow. I think you are right. Cross checking at the fuji website shows none of their mentioned cameras being sold in north america. Pictures of Fuji selling cameras in north america market but no similar design products on their Fuji website. You could be right. Kodak and Fuji have a progressing deal taking place under neath our own eyes. It doesnt take a rocket scientist to figure it out. Why doesnt Fuji website not show their new designed cameras? In north america the same design features kodak offered are now being offered by Fuji. Do your due diligence and attest the pictures of products being offered. thank you
