"This deal is certainly one of the largest technology patent deals of 2012," said Shawn Ambwani, High Tech Sector Deal of Distinction Chair. "It impressed the Sector not only because of its sheer size and the breadth of its coverage, but also because of its highly complex final structure given existing litigation, Kodak's creditors, and the number of participants involved in the final consortium." The awards will be presented during the Society’s annual meeting, September 22-25, when deal executives will share insights about the dynamics of their transactions. You remember the explanation from the nay sayers right...that the patents were "sold" to IV and RPX for 125 million and they would collect the profits from any licensing in the future...that is the kind of BS you get when the truth is withheld with redactions...! Criminals...every stinking one of them!

Wait so this is actually a licensing deal instead of an actually sale... that might be a bit confusing and misleading.
This whole kodak BK is bullshit, I am sick and tired of the BS being pulled. Every aspect has just been exhausting to try to figure out.
I feel like this will be a great company again when they emerge, but WTF they have literally screwed over everyone they could get their hands on...

Kodak always retained a license to use. IVI and company own the patents. If you don't believe me, go to the USPTO and check. All the assignee designations have been changed to IVI or Apple, or one of the others. Do not expect a licensing revenue stream.

I described the transaction in detail in this forum when the deal was finalized. It is just structured as a sale to Intellectual Ventures who then license it to the consortium. Some patents ownership was transferred to Apple etc in its entirety. The reasons for arranging the deal that way is a matter of strategy and logistic that benefits the whole consortium. The issue was analyzed in detail in my post if anyone cares to search for it. Bottom line. There is no recurring licensing fee for Kodak to collect.
